At Conlon Amendola, PLLC, we provide the following legal services.

Child Custody and Visitation

Child custody is the term defining the legal relationship between a guardian or parent and the child in their care. It is a combination of legal custody, which is when an individual can make decisions regarding the child, and physical custody, which is the responsibility to care for the child and provide a home to live in. The establishment of custody is not always a straightforward process, and can take much effort and investigation. Included in this process is the establishment of visitation. Visitation is the time allotted to any non-custodial parent to a child. It is dependent on a multitude of factors to determine what is in the best interests of the child, which will be addressed during the legal process.

Conlon Amendola, PLLC takes on child custody and visitation cases that involve:

  • Establishing Parental Rights
  • Creating Parenting Plans
  • Relocation Cases

Prenuptial and Postnuptial agreements

Premarital agreements are sometimes referred to as antenuptial agreements or prenuptial agreements. A premarital agreement is a contract that a couple chooses to enter before becoming legally married or joined in civil union. It essentially permits the couple to select the legal rights they can acquire upon marriage. It also details the process that follows if the couple divorces or if a spouse dies.

Our firm understands that without legal expertise and background knowledge, it can be difficult to execute an accurate and good-faith prenuptial agreement between partners. We offer assistance throughout the process and ensures that your best interests are properly represented.

Establishing what happens to legal rights and assets before a couple joins in a legal union or marriage is a commonly-known practice, but did you know that you can also settle affairs and assets after marriage in the event of separation or divorce through a postnuptial agreement as well? Postnuptial agreements began garnering attention in the 1970s, and are used today, after a couple is married, to legally specify rights and asset division in the case of separation, divorce or death of a partner

What you might include in a postnuptial agreement, as well as what cannot be included, is largely governed by state law. Parties commonly include specific sections that address division of assets in the event of divorce, how assets will be managed in the event of a spousal death, how marital debts and dues will be divided, and whether or not one spouse will need to pay spousal support or child support in the event of separation. These and other specifications are reviewed and granted or denied by the state.
